Welcome to Why. These Terms are the agreement between you (the parent or guardian setting up the app) and Merek Jones, doing business as "Why," for the use of the Why app and the website at why.arwrench.com. By using Why, you agree to what's below. We've tried to write it in plain English.
Why is a voice-based AI helper for kids. After a short setup by a parent, a child can tap a button, ask a "why?" question out loud, and hear a kid-friendly answer spoken back. The answers are generated by an artificial intelligence service. Why also offers optional parent report summaries that highlight what the child has been curious about.
You must be at least 18 years old to set up Why and agree to these Terms. Why is designed for children ages 3–12, but the app must be set up by a parent or legal guardian, and that adult must remain the responsible account holder.

We may suspend or terminate access if we discover misuse. Since Why has no accounts, "termination" in practice means blocking the device or IP from further AI requests.
You are responsible for supervising your child's use of Why. We strongly recommend that you stay nearby during early sessions to confirm the app feels right for your family, and that you use the parent report features to stay aware of what your child is asking about.
Why's answers are written by an AI, not a human. We use carefully tuned prompts and age-appropriate guardrails, but AI systems can occasionally produce information that is incorrect, oversimplified, outdated, or worded awkwardly. Why is meant to spark curiosity and give kids a starting point — it is not a substitute for a teacher, a doctor, a counselor, or your judgment as a parent. Please review answers with your child, especially on topics that matter to your family.
Why does not provide medical, legal, financial, mental-health, or other professional advice. Anything that sounds like advice is general information only.
The Why app, the website, the wordmark, and the underlying code are owned by Merek Jones. You're granted a personal, non-exclusive, non-transferable, revocable license to use Why on your family's devices for non-commercial purposes. You do not gain any ownership of Why itself.
Answers generated by the AI are not copyrightable as such; you're welcome to use, screenshot, or quote them for personal and family purposes.
Why is provided "as is" and "as available," without warranties of any kind, whether express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, non-infringement, accuracy, or uninterrupted operation.
We do not warrant that Why will be error-free, that AI answers will be accurate, that the service will always be available, or that the app will work on every device and browser combination.
To the maximum extent permitted by law, Merek Jones, doing business as Why, will not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits, data, goodwill, or other intangible losses, resulting from your use of Why — whether based on warranty, contract, tort, or any other legal theory.
In any event, our total liability for any claim related to Why will not exceed the greater of (a) the amount you actually paid to Why in the 12 months prior to the claim, or (b) twenty U.S. dollars ($20).
Some jurisdictions don't allow these limits — in those places, our liability is limited to the minimum permitted by law.
You agree to defend and hold Merek Jones harmless from claims arising out of your misuse of Why, your violation of these Terms, or your violation of someone else's rights through your use of the app.
Why is a small, evolving product. We may add features, change features, or retire features. We may also temporarily pause the AI components for maintenance, safety, or cost reasons. We'll try to communicate significant changes through the app.
If we update these Terms, we'll change the "Effective" date at the top of this page. Material changes (anything that meaningfully affects your rights or obligations) will be surfaced in the app on next launch so you can review them before continuing. Continued use after a change means you accept the updated Terms.
These Terms are governed by the laws of the State of [US STATE], without regard to its conflict-of-laws rules. You and Why agree that any dispute that can't be resolved by friendly email will be brought in the state or federal courts located in [US STATE], and you consent to that jurisdiction.
You can stop using Why at any time. Tap the gear icon and use "Reset profile & conversation" to clear what's stored on your device, then uninstall or close the app. Because there are no accounts, there is nothing else to cancel.
If any part of these Terms is found unenforceable, the rest still applies. These Terms, together with the Privacy Policy, are the entire agreement between you and Why about the service.
